Welcome to the FUJIFILM Print to Prove It campaign terms and conditions (“Terms and Conditions”).

These documents constitute the entire agreement between us (FUJIFILM UK Limited) and you with respect to the offer made via the FUJIFILM Print to Prove It website (“Website”), including the submission by you of any Content to the Website, including your name and email address.

We reserve the right to change these Terms and Conditions at any time. We recommend you check the link to these Terms and Conditions on the Website for changes each time you use the Website.

Please read these Terms and Conditions carefully. You must comply with these Terms and Conditions to take advantage of the offer on the Website. By accessing or using the Website you accept these Terms and Conditions and agree to be legally bound and subject to them. Acceptance of these Terms and Conditions creates a binding legal agreement between you and us that you will comply with these Terms and Conditions and use the Website only in a manner consistent with these Terms and Conditions. If you do not agree with these Terms and Conditions, do not access the Website or use any of its services.

1. Definitions

In these Terms and Conditions the following expressions shall have the following meanings unless otherwise stated:

“Consumer” means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession;

“Content” means any materials or content submitted or uploaded to the Website;

“you” and “your” means the person registering for, accessing or using the Website under these Terms and Conditions.

2. Signing up for Offer

(a) To be eligible for the offer on the Website you need to provide us with your name and your email address (which must be a genuine email address) and consent to us marketing to you. Confirmation of your eligibility will be sent to you by email. We may at our absolute discretion, refuse to accept your application. Once your application is accepted we will enable you to receive one free photo print voucher entitling you to receive five free standard prints from our myFUJIFILM photo and imaging service website (postage is however excluded from this offer). We only permit one application for each genuine email address. Your email address will be used for sending you all notices. By using the Website, you represent that the information you provide about yourself when registering is true, accurate and up-to-date.

(b) In order to obtain your five free standard prints from our myFUJIFILM photo and imaging service website (myfujifilm.com), please note that you will need to upload the photos you want to print. When you get to the “checkout” stage, you must enter your email address (which by default creates an account on myfujifilm.com (terms and conditions can be found here: Terms and Conditions | myFUJIFILM) and other details to allow delivery of the prints to you and then pay for postage.

3. Termination

(a) Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Website without notice. We may terminate your eligibility for the offer on the Website with immediate effect if you are in breach of these Terms and Conditions. We also reserve the right to terminate your eligibility for the offer on the Website at our discretion in which case we will endeavour to give you reasonable notice (or at least two days’ notice).

(b) If you wish to terminate your eligibility for the offer on the Website or withdraw your marketing consent at any time, you may do so by advising us by email. Please email us at photoprintservices_uk@fujifilm.com and put “FUJIFILM Print to Prove It” in the email header.

(c) If your eligibility for the offer on the Website is terminated, you will no longer be able to such offer.

4. Children Not to become a Member of this Service

(a) We are particularly concerned to preserve and protect the privacy of children and their personal information.

(b) If you are under the age of 16 years you must not apply for eligibility for the offer on the Website. Please do not attempt to submit any information about yourself to us (such as your name, address, telephone number or email address).

(c) If you are aged from 16 to 18, you should obtain permission from your parents or guardians before applying for eligibility for the offer on the Website and sending any information about yourself to us.

5. Our Liability to You

(a) Your access of or use of the Website is at your own risk. You should take appropriate steps to protect your device against any damage that could result from your access to or use of the Website. The Website may not be error free or uninterrupted. We do not give any commitment in relation to the security, reliability, timeliness and performance of the Website. To the extent permitted by law we are not responsible for interruption of the Website, linkage to any third party sites, damage to your device, damage to other property or loss of Content or other data resulting from your access to or use of the Website.

(b) Our total aggregate liability to you in connection with the provision or non-provision of the Website or otherwise in connection with the subject matter of these Terms and Conditions, whether arising in contract, tort, misrepresentation or otherwise, will in all circumstances be limited to £5 or if you are a Consumer we will also be liable for any other losses or damage you suffer which are a foreseeable consequence of the provision or non-provision of the Website or otherwise in connection with the subject matter of these Terms and Conditions. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

(c) Nothing in these Terms and Conditions excludes or limits our liability for any matter for which it would be illegal for us to exclude or attempt to exclude our liability to you. If you are a Consumer by this we mean that nothing in these Terms and Conditions shall limit or exclude in any way our liability for any breach of the terms implied by the Consumer Rights Act 2015, for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

If we wish to give you notice under these Terms and Conditions, we will do so by email to the email address provided by you in relation to your application.

7. Privacy

The privacy of your personal information is important to us and is governed by our Privacy Policy (click here). Should you have any questions concerning privacy, please refer to our Privacy Policy.

8. Entire Agreement

These Terms and Conditions and any document expressly referred to in them constitute the whole agreement between us and supersede any previous arrangement, understanding or agreement between us.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the Courts of England and Wales.

10. Severability

If any court of competent jurisdiction finds any provision or part thereof of these Terms and Conditions to be illegal, invalid or unenforceable that provision or part thereof shall be severed from these Terms and Conditions and the remaining terms and provisions of these Terms and Conditions shall remain in force.

11. Waiver

The failure by us to enforce any right or provision of these Terms and Conditions will not restrict us from enforcing it now or in the future.
